The Regulation on Natural Gas Futures Market Vadeli Doğal Gaz Piyasasına İlişkin Düzenleme
 

“The Regulation Amending the Organized Natural Gas Wholesale Market Regulation” was published on the Official Gazette dated 12.01.2021.


According to the concerned regulation; the market participants who would like to carry transactions in the natural gas futures market, shall sign the Natural Gas Futures Market (“NGFM”) participation agreement in addition to the Standard Transportation Agreement (“STS”) and the Continues Trading Platform (“CTP”) participation agreement. The NGFM participation agreement will be valid for the period of the STS participation agreement.


The system users who earned the market participant title, will be entitled to carry transactions in the NGFM provided that they signed the NGFM participation agreement and that they comply with other issued specified in the Natural Gas Futures Market Operation Procedures and Principles (“NGFMOPP”).


Every market participant will be obliged to assign his market operator pursuant to STS and CTP participation agreement as broker agent in order for the reconciliation of the market transactions.


Matters concerning the guarantee obligations in the natural gas futures market are to be regulated under the NGFMOPP.


A default guarantee account will be created in the natural gas futures market for losses caused by the default of the market participants concerning the amount exceeding the guarantees of these market participants.


The details regarding this subject are expected to be clarified with the publication of GFMOPP which will be regulated by Energy Market Regulatory Authority (“EMRA”).

12.01.2021 tarihli Resmi Gazete’de “Organize Toptan Doğal Gaz Satış Piyasası Yönetmeliği’nde Değişiklik Yapılmasına Dair Yönetmelik” yayımlanmıştır.



İlgili yönetmeliğe göre; vadeli doğal gaz piyasasında işlem yapmak isteyen piyasa katılımcıları, Standart Taşıma Sözleşmesi (“STS”) ve Sürekli Ticaret Platformu (“STP”) katılım anlaşmasına ilave olarak Vadeli Doğal Gaz Piyasası (“VGP”) katılım anlaşmasını da imzalayacaklardır. VGP katılım anlaşması STP katılım anlaşması süresince geçerli olacaktır.


Piyasa katılımcısı sıfatını kazanan sistem kullanıcıları, VGP katılım anlaşmasını imzalamak ve Vadeli Doğal Gaz Piyasası İşletim Usul ve Esasları’nda (“VGPUE“)
belirtilen diğer hususları yerine getirmek kaydıyla VGP’de işlem yapmaya hak kazanacaktır.


Her piyasa katılımcısı, piyasa işlemlerinin uzlaştırılmasını teminen STP ve VGP katılım anlaşması gereğince piyasa işletmecisini aracı olarak atamakla yükümlü olacaktır.


Vadeli doğal gaz piyasasındaki teminat yükümlülüğüne ilişkin hususlar VGPUE’de yer alacaktır.


Vadeli doğal gaz piyasasında, piyasa katılımcılarının temerrüde düşmesi halinde oluşabilecek zararların ilgili piyasa katılımcılarının teminatlarını aşan kısmı için kullanılmak üzere bir temerrüt garanti hesabı oluşturulacaktır.


Konuya ilişkin detayların Enerji Piyasası Düzenleme Kurulu (“EPDK”) tarafından düzenlenecek olan VGPUE’nin yayımlanmasıyla birlikte netleşmesi beklenmektedir.
