AMENDMENTS TO GENERAL COMMUNİQUE ON NATIONAL PROPERTY (NO: 313)

Communiqué (No: 319) on Amendment to the General Communiqué on National Property (No: 313) published in the Official Gazette dated 21 August 2019 (“Communiqué 391”) brought about certain changes. In summary, for the private immovable property pertained to treasury, the Communiqué 391;

  • assigned responsibility of sale transactions to Ministry of Environment and Urbanization which had been previously under the authority of Ministry of Treasury and Finance,
  • revised the price determination applied in the sale which has been previously calculated based on construction unit square meter price in accordance with the Real Estate Tax Law numbered 1319, is now calculated based on the approximate unit cost estimated by the Ministry of Environment and Urbanization
  • with respect to the collection of remuneration; has brought new principle for the sale of immovable properties in which the easement right has been established. As such, if the 30% down payment is paid, remaining payments might be paid in ten instalments within 5 years and it is stated that the easement rights and sales prices will be deducted from the instalments.
