Çek Kanununda Yer Alan Karşılıksız Çek Keşide Etme Suçunun Cezasına İlişkin Üç Değişiklik

28 Temmuz 2021 tarihli Resmi Gazete’de 7333 sayılı Bazı Kanun ve Kanun Hükmünde Kararnamelerde Değişiklik Yapılmasına Dair Kanun (“Kanun”) yayımlanmıştır. Bu kanunun ilgili 17. maddesi 5941 sayılı Çek Kanunu’nun (“Çek Kanunu”) geçici 5. maddesinde düzenlenen karşılıksız çek keşide etme suçunun cezasına ilişkin değişiklikleri kapsamaktadır.

Çek Kanununun geçici 5.maddesi “30/4/2021 tarihine kadar işlenen suçtan dolayı mahkûm olanların cezalarının infazı durdurulur.” hükmünü düzenlenmiştir. Bu düzenleme ile karşılıksız çek keşide etme suçunu 24/03/2020 tarihine kadar işlemiş kişilerin infazının durdurulması şeklinde olan düzenleme 20/04/2021 tarihine uzatılmıştır.

Yapılan bir diğer değişiklik ise çek bedelinin ödenmeyen kısmının %10’luk kısmının ödeneceği zaman aralığında olmuştur.

Değişiklik yapılmadan önce bu aralık “en geç üç ay içerisinde” olarak düzenlenmiştir. Değişiklik ile bu süre 28/07/2021 tarihinden başlamak suretiyle 30/06/2022 tarihine uzatılmıştır.

Değişiklik yapılan diğer madde ise çekin %90’lık kalan kısmının ödendiği takdirde, mahkemenin kararına ilişkindir.

Değişiklik ile, çekin %90’lık kısmının üç aylık öngörülen sürenin sona ermesinden başlayacak şekilde ikişer ay ara ile on beş eşit taksitle ödenmesi durumunda şikâyete bağlı olarak mahkemenin hükmün infazına devam etme kararı, 30/06/2022 tarihini takiben ikişer ay ara ile on beş eşit taksitle ödenmesi durumunda şikâyete bağlı ceza mahkumiyeti bütün sonuçları ile ortadan kaldırılması olarak revize edilmiştir.

Three Amendments to the Check Law’s Regulation on the Penalty for the Offense of Drawing a Bounced Check

The Law Amending Certain Laws and Statutory Decrees No. 7333 (“Law”) was published in the Official Gazette on 28 July 2021. The relevant Article 17 of this law covers the changes regarding the penalty of drawing bad checks, which is regulated in the provisional Article 5 of Check Law No. 5941 (“Check Law”)

Provisional Article 5 of Check Law regulates that “The execution of the sentences of those convicted of crimes committed is suspended.” With this, the regulation that regulates the halt of execution of people who have committed the crime of drawing bad checks until 24/03/2020 has been extended to 20/04/2021.

Another amendment that has been made was in the time interval in which 10% of the unpaid amount of the check value would be paid.

Before the change, the time interval was regulated as “within three months at the latest.” With the amendment, this period has been extended to 30/06/2022 starting from 28/07/2021.

The other amended article concerns the decision of the court if the remaining 90% of the check is paid.

With the amendment, if 90% of the check is paid in fifteen equal instalments at two-month intervals, starting from the expiry of the stipulated period of three months, the court’s decision to continue the execution of the judgment depending on the complaint is made in fifteen equal instalments at two-month intervals following the date of 30/06/2022. In case of payment in instalments, the criminal conviction due to the complaint has been revised as the abolishment of all its consequences.
