The Economic Regulation Bill Has Passed into Law

Ekonomiye İlişkin Düzenlemeler İçeren Kanun Teklifi Yasalaştı
 

“The Law Amending the Law on the Procedure for the Collection of Public Receivables and Certain Laws” has been adopted by the General Assembly of Grand National Assembly of Turkey (“GNAT”).


Pursuant to the relevant law:


–     Corporate Tax, which was 20 percent, has been increased to 25 percent for the year 2021 and 23 percent for the year 2022.


–     The sectors to be given unpaid leave support and premium support have been expanded and in that direction; the sectors determined by the law, which include internet cafes, sports, entertainment, weddings and spa sectors have been added to the scope.


–     The regulation enabling public institutions and organizations to sell real estate and movable property through auction in electronic environment has been accepted.


–     The goods that cannot be stored due to deterioration, rot or similar reasons, the goods that are expected to significantly depreciate when stored and the goods storage of which will be dangerous or costly can be sold through bargaining in the appropriate place and those with the exchange market can be sold in the relevant market.


–     The debts of agricultural credits, which were transferred to the account of receivables to be liquidated as of December 31, 2020, will be structured.

“Amme Alacaklarının Tahsil Usulü Hakkında Kanun ile Bazı Kanunlarda Değişiklik Yapılmasına Dair Kanun” Türkiye Büyük Millet Meclisi (“TBMM”) Genel Kurulunda kabul edilerek yasalaştı.


İlgili kanun uyarınca:


–     Yüzde 20 olarak uygulanan kurumlar vergisi 2021 yılında yüzde 25, 2022 yılında yüzde 23 uygulanacak şekilde artırıldı.


–     Ücretsiz izin desteği ve prim desteği verilecek sektörlerin kapsamı genişletildi ve internet kafe, spor, eğlence, düğün, kaplıca sektörleri dahil olmak üzere kanunda belirlenen sektörlerde faaliyet gösteren iş yerleri de kapsama alındı.


–     Kamu kurum ve kuruluşlarının menkul ve gayrimenkul malları elektronik ortamda açık artırmayla satabilecekleri düzenlendi.



–     Bozulma, çürüme ve benzeri sebeplerle korunması mümkün olmayan ya da beklediği zaman önemli bir değer düşüklüğüne uğrayacağı anlaşılan mallar ile muhafazası tehlikeli veya masraflı olan malların en uygun yerde pazarlıkla, borsası bulunan malların ise ilgili borsada satılabileceği düzenlendi.



–     31 Aralık 2020 tarihi itibariyle tasfiye olunacak alacaklar hesabına aktarılmış olan tarımsal kredi borçlarının yapılandıracağı düzenlendi.
