The Decision of the Constitutional Court with the Application Number 2018/5832 Determining About the Arbitration Clause Is Published on the Official Gazette

Anayasa Mahkemesi’nin 08.06.2021 tarihli ve 2018/5832 başvuru numaralı kararı yayımlandı.

Karara konu olayda ilk derece mahkemesinde açılan tazminat davasında sözleşmede yer alan yabancı tahkim kaydı gerekçe gösterilerek tahkim itirazında bulunulmuş ancak mahkeme itirazı iptal ederek davayı kabul etmiştir. Kararın temyiz merciine taşınması üzerine Yargıtay tahkim kaydının geçerli olduğunu tespit etmiş ve bu nedenle görev yönünden reddi gereken davanın kabulü sonucu hüküm kurulmasını isabetsiz bulmuştur.

Bozma kararına uyularak kesinleşen karar için Anayasa Mahkemesi’ne başvuran Başvurucu, görevsizlik kararının kesinleşmesinin yedi yıl sürmesi ve bu süreçte İngiliz Hukuku uyarınca zamanaşımına uğrayan alacağını tahsil etmek için yabancı tahkim yoluna başvurmasının anlamsız hale geldiğini öne sürerek zararının tazmin edilmesi imkanının elinden alındığı iddiasıyla bireysel başvuruda bulunmuştur.

Anayasa Mahkemesi kararında Başvuranın, davanın görev yönünden reddi sonrasında tahkim yargılamasına başvurarak zamanaşımı nedeniyle talep hakkının kalmadığını ispat edebileceği halde bu yola başvurmadığı tespit etmiş ve buna ek olarak başından itibaren  basiretli bir tacirin tahkim kaydına rağmen dava açması halinde tahkim itirazıyla karşılaşma ve bu gerekçeyle de mahkemenin görevsizlik kararı vermesi riskini öngörebilmesi gerektiğini ve Anayasa Mahkemesinin alternatif bir temyiz merci olarak görev yapmadığını tespitlerinde bulunarak iddiayı hukuki dayanaktan yoksun bularak reddetmiştir.

The decision of the Constitutional Court dated 08.06.2021 and numbered 2018/5832 was published.

In the case subject to the decision, an objection to arbitration was made in the compensation case filed in the court of first instance, on the grounds of the foreign arbitration record in the contract, but the court accepted the case by cancelling the objection. Upon taking the decision to the appeal authority, the Court of Cassation determined that the arbitration record was valid, and therefore, it found the establishment of a judgment inaccurate as a result of the acceptance of the case that should be rejected due to the lack of subject matter jurisdiction.

The Applicant, who applied to the Constitutional Court for the decision that was finalized in accordance with the annulment decision, filed an individual application claiming that it took seven years for the decision of non-jurisdiction to become final and that it had become meaningless to apply to foreign arbitration in order to collect the expired receivables due to limitation period in accordance with English Law.

In its decision, the Constitutional Court determined that the applicant did not resort to this procedure, although the Applicant could prove that they had no right to demand due to the statute of limitations by applying to arbitration after the dismissal of the case in terms lack of subject matter jurisdiction and, in addition, the Applicant should be able to foresee the risk that if a prudent trader files a lawsuit despite his arbitration record, they will face an objection to arbitration and therefore the court will issue a decision of non-jurisdiction. Also, found that the Constitutional Court did not function as an alternative appellate authority, and dismissed the claim as devoid of legal basis.
