The Constitutional Court Annulled the Regulation that Required Security Investigation Prior to Admission to the Civil Service

 

Anayasa Mahkemesi Memuriyete Girişte Güvenlik Soruşturması Şartı getiren Düzenlemeyi İptal Etti

15 Temmuz darbe girişiminin ardından yürürlüğe konulan düzenlemeyle kamu hizmeti ve görevine atanacaklar hakkında güvenlik soruşturması ve arşiv araştırması yapılması şartı getirilmişti. Anayasa Mahkemesi, 29.11.2019 tarihinde Resmi Gazete’de yayımlanan kararıyla bu düzenlemeyi iptal etti. Anayasa Mahkemesi kararında, kişisel verilerin ve özel hayatın gizliliğinin korunmasının anayasal teminat altında olduğunu hatırlatarak güvenlik soruşturması ve arşiv araştırması sonucunda devlet memurluğuna atanılmada esas alınacak kişisel veri niteliğindeki bilgilerin alınmasına, kullanılmasına ve işlenmesine yönelik güvencelerin ve temel ilkelerin kanunla belirlenmeksizin bunların alınmasına ve kullanılmasına izin verilmesinin Anayasa’nın 13., 20. ve 128. maddeleriyle bağdaşmadığını belirtti.

Anayasa Mahkemesi ayrıca terör suçlarından tutuklu bulunanların cezaevinde avukatlarıyla yaptıkları görüşmelerin kayıt altına alınmasına, bu görüşmeler sırasında birbirlerine verdikleri belgelere el konulmasına ve görüşmelerin sınırlandırılmasına ilişkin düzenlemelerin de iptaline karar verdi.

The Constitutional Court Annulled the Regulation that Required Security Investigation Prior to Admission to the Civil Service

After the coup attempt of July 15th, conducting a security investigation and an archive research for those who would be assigned to public service and duty prior to their posting was made compulsory. The Constitutional Court annulled this regulation with the decision published in the Official Gazette on 29.11.2019. The Constitutional Court, reminding that the protection of the privacy of personal data and private life is under constitutional guarantee, stated that giving permission to the collection and usage of information collected through security investigations and archive research, and on which the appointment to civil service would be based without specifying, in a statute, the guarantees and the basic principles regarding the collection, use and processing of personal data was not in compliance with Articles 13, 20 and 128 of the Constitution.

The Constitutional Court also annulled regulations which impose that the meetings between detainees of crimes of terrorism and their lawyers be recorded, such meetings be conducted in certain time limits and the documents exchanged between detainees and their lawyers during those meetings are seized.
