| As it is common knowledge, surveillance is an application for monitoring the import of a product with the “Surveillance Certificate” to be issued by the Ministry of Trade. On this basis, a surveillance certificate is necessary in addition to the documents required by the customs legislation during import for the products subject to surveillance. While the general framework of the surveillance practice is drawn by the Decree on the Implementation of Surveillance in Imports published in the Official Gazette dated 29.05.2004 and the regulation dated 08.06.2004, the products to be applied surveillance are determined by communiqués.
Pursuant to the Communiqué on the Amendment of the Communiqué on Surveillance in Import, published in the Official Gazette on 26.01.2021, the import of some parts produced to be used in the smart mobile phone production will be exempted from the surveillance application. According to the communiqué, surveillance value will not be applied in the importation of components and parts of which the main card compositions are complete and completely demounted to be used in smart mobile phone production. Previous to the communiqué, surveillance value of 5 USD was applied per item for the beforementioned products.

Bilindiği üzere gözetim uygulaması bir ürün ithalatının, Ticaret Bakanlığınca düzenlenecek “Gözetim Belgesi” ile izlenmesine yönelik bir uygulamadır. Bu kapsamda gözetime tabi tutulan ürünler açısından ithalat sırasında gümrük mevzuatının gerektirdiği belgelerin yanında gözetim belgesi de aranmaktadır. Gözetim uygulamasının genel çerçevesi 29.05.2004 tarihli Resmî Gazete’de yayımlanan İthalatta Gözetim Uygulanması Hakkında Karar ve 08.06.2004 tarihli yönetmelik ile çizilirken gözetim uygulanacak ürünler tebliğler aracılığı ile belirlenmektedir.
26.01.2021 tarihinde Resmî Gazete’de yayımlanan İthalatta Gözetim Uygulamasına İlişkin Tebliğ’de Değişiklik Yapılmasına Dair Tebliğ uyarınca akıllı cep telefonu üretiminde kullanılmak üzere üretilen bazı parçaların ithalatı gözetim uygulamasından muaf tutulacaktır. Tebliğe göre, akıllı cep telefonu üretiminde kullanılmak üzere kullanılacak ana kart dizgisi tamamlanmış ve tamamen demonte haldeki aksam ve parça ithalatında gözetim kıymeti uygulanmayacaktır. Adı geçen ürünler için düzenlemeden önce adet başına 5 USD Gözetim Kıymeti uygulanıyordu.
