COVID-19 Recess to the Enforcement and Bankruptcy Proceedings


22 Mart 2020 tarihinde, 31076 sayılı Resmi Gazete’de yayımlanan Cumhurbaşkanı Kararı’yla nafaka alacaklarına ilişkin icra takipleri hariç olmak üzere, yurt genelinde yürütülmekte olan tüm icra ve iflas takiplerinin 30.04.2020 tarihine kadar durdurulmasına karar verildi. COVID-19 salgın hastalığının ülkede yayılmasını önlemek için alınan tedbirler kapsamında alındığı belirtilen kararda aynı zamanda anılan tarihe kadar hiçbir taraf ve takip işleminin yapılmayacağı, yeni icra ve iflas taleplerinin alınmayacağı ve ihtiyati haciz kararlarının icra ve infaz edilmeyeceği belirtilmekte.

Daha öncesinde Hakimler ve Savcılar Kurulu (HSK) da COVID-19 salgın hastalığıyla mücadele kapsamında mahkemelere hitaben yayımlamış olduğu bildiriyle tutuklu işlere yönelik soruşturma ve kovuşturmalar ile ivedi sayılacak diğer hususlar haricinde duruşma ve keşiflerin ertelenmesi ile gerekli olan hallerde mahkemede hazır bulunamayan kişilerin video konferans yoluyla dinlenilmesini sağlayan SEGBIS sisteminin kullanılması hususunun mahkemelerce değerlendirilmesi tavsiyesinde bulunarak salgın süresince mahkemelerin gerekli dikkat ve özeni göstermesi gerektiğini belirtmişti.

With the President’s Decision (Decision) published in the Official Gazette No. 31076 on March 22, 2020, it was decided to stop all enforcement and bankruptcy proceedings carried out throughout the country until 30.04.2020, except for the execution proceedings related to maintenance payments. The Decision, which is part of the measures taken to prevent the spread of the COVID-19 epidemic in the country, also foresees that no party or enforcement action shall be made, no new requests for enforcement and bankruptcy shall be taken and no provisional attachments shall be enforced or executed until the mentioned date.

Previously, with an aim to fight against the epidemic of COVID-19, the Council of Judges and Prosecutors (CJP) had also published a declaration urging the courts to show the necessary attention and care during the epidemic while advising the courts, in this regard, to consider postponing the trials and discoveries other than investigations and prosecutions regarding imprisoned persons and other issues that are considered urgent, and to use, if necessary, SEGBIS -a system that allows people who cannot be present before a court to be heard through video conference-.
