Hazine ve Maliye Bakanlığı, 30.12.2019 tarihinde Resmi Gazete’de yayımladığı tebliğle yıllık %19 olarak uygulanmakta olan tecil faizinin söz konusu tebliğin yayımı tarihinden itibaren yıllık %15 olarak uygulanacağını duyurdu.

Tecil Faizi Nedir?

Amme Alacaklarının Tahsiline İlişkin Kanunu’nun 48. Maddesi amme borcunun vadesinde ödenmesinin borçluyu çok zor duruma düşüreceği hallerde borçlu tarafından yazı ile talep edildiği ve teminat gösterilmiş olmak şartıyla yetkili makamlarca amme alacağının tecil olunabileceğini öngörmektedir. Amme borcunun tecil olunduğu süre boyunca söz konusu borca uygulanacak faize ise tecil faizi adı verilmektedir.

With the communiqué published in the Official Gazette on 30.12.2019, the Ministry of Treasury and Finance announced that the postponement interest, which is applied as 19% per annum, will be applied as 15% per annum as of the publication date of the communiqué in question.

What is a postponement interest?

Article 48 of the Law no. 6183 on the Collection of Public Receivables stipulates that in cases where paying the public debt on its due date will put the debtor in a very difficult position, authorized public authorities may postpone the due date of the public debt provided that a request in this regard has been made by the debtor in writing and the collateral has been submitted. The interest to be applied to the public debt during the period of deferral is called postponement interest.
