Enerji ve Tabii Kaynaklar Bakanlığı (“Bakanlık”) Türkiye’de yenilenebilir enerji kaynaklarının kullanımının yaygınlaştırılması amacıyla yürüttüğü faaliyetlerine bir yenisini daha ekledi. Bakanlık, 3 Temmuz 2020’de Resmî Gazete’de yayımladığı ilanla toplam 74 Güneş Enerjisi Yenilenebilir Enerji Kaynak Alanları (“YEKA”) projelerine ilişkin yarışma (“Yarışmalar”) yapılacağını duyurdu.  Yarışmaların 74 yeni güneş enerjisi santralinin, 36 ilde ve bağlantı noktaları 10, 15 ve 20 MWe (Megavat) arasında değişen, toplam gücü 1000 MWe olan bağlantı noktalarının tahsisine ilişkin olduğu belirtildi.

Yarışmalar, 09/10/2016 tarih ve 29852 sayılı Resmî Gazete’de yayımlanan Yenilenebilir Enerji Kaynak Alanları Yönetmeliği’nde (“Yönetmelik”) yer alan Yerli Malı Kullanım Karşılığı Tahsis (“YMKT”) yöntemine göre gerçekleştirilecektir. Yönetmelik’in 4. Maddesinin 1. Fıkrasının, o bendi uyarınca YMKT yöntemi, yenilebilir enerji kaynaklarından elektrik enerjisi üretim tesisinde yerli malı kaynak kullanımının taahhüt edilmesini ifade eder.

Yarışma başvuruları 19-23 Ekim 2020 tarihleri arasında yapılacak olup Yarışmalar’a başvurabilmek için herhangi bir mali yeterlilik veya iş deneyimi şartı aranmamaktadır. Buna göre yarışma şartnamesinde belirtilen şartları sağlamaları ve istenen belgeleri sunmaları halinde Türk Ticaret Kanunu’na göre kurulmuş her anonim ve limitet şirket Yarışmalar’a başvurabilecektir. Her bir yarışmaya katılabilmek için satın alınması gereken şartname ücreti ise 2.000 Türk Lirası olarak belirlenmiştir. Bununla birlikte her bir yarışmaya katılabilmek için i) başvuru aşamasında kesin, ii) 1 yıl süreli, iii) tamamen ve kısmen nakde çevrilebilir, iv) limit dışı ve v) 10 MWe kapasiteli yarışmalar için 3.500.000 Türk Lirası, 15 MWe kapasiteli yarışmalar için 5.500.000 Türk Lirası, 20 MWe kapasiteli yarışmalar için 7.000.000 Türk Lirası tutarındaki teminat mektubu sunulması gerekmektedir. Her bir yarışma için başlangıç fiyatı tavan fiyat 30 Krş/KWh ve elektrik enerjisinin alım süresi sözleşmenin imzalandığı tarihten itibaren 15 yıl olarak belirlenmiştir.

The Ministry of Energy and Natural Resources (“Ministry”) has commenced a new activity in order to popularize the usage of the renewable energy resources. On July 3, 2020, the Ministry has announced in the Official Gazette that there will be  competitions (“Competitions”) regarding 74 Solar Power Renewable Energy Resource Area (“YEKA”) projects. The subject matter of the Competitions of 74 new solar power plants will be the allocation of connection regions which have a total capacity of 1000 MW varying between 10 MW and 20 MW for each connection region.

Competitions will be conducted in accordance with the allocation in Exchange for Use of Domestic Products (“YMKT”) method that is regulated in the Renewable Energy Resource Areas Regulation (“Regulation”) which was published on October 9, 2016, in the Official Gazette No. 29852. According to Article 4, Subclause 1/o, of the Regulation, the YMKT method amounts to the undertaking of the use of domestic products in the electricity production plants.

Applications to the Competitions will collected between the 19th and 23th of October, 2020, and financial capability and business experience are not necessary to apply to the Competitions. Any company which have been established either as a joint-stock company or a limited liability company under the Turkish Code of Commerce may apply to the Competitions provided that they satisfy the conditions included in the specification of the relevant competition and present the required documents. The purchase price of each competition specification is TRY 2000. Furthermore, in order to be able to apply to a competition the applicants must submit a letter of guarantee which shall be i) certain  on the application stage, ii) for 1 year-term, iii) completely or partially convertible to cash, iv) out of limit and v) in the amount of  TRY 3.500.000 for the competitions which have 10MWe capacity, vi) TRY 5.500.000 for the competitions which have 15MWe capacity and vii) TRY 7.000.000 for the competitions which have 20 MWe capacity. For each competition, the maximum price is determined to be 30 Krş/KWh and the price guarantee is determined to last 15 years which will commence from the signing date of the YEKA Usage Right Agreement.
