Enerji Piyasası Düzenleme Kurumu (EPDK), Elektrik Piyasasında Lisanssız Elektrik Üretim Yönetmeliğinde önemli değişiklikler yaptı. Yapılan değişiklik 11 Ağustos 2022 tarihli Resmi Gazete’de yayımlandı ve aynı tarihte yürürlüğe girdi.

Energy Market Regulatory Authority (EMRA) has made significant amendments to the By-Law on the Unlicensed Electricity Generation in the Electricity Market. The amendments were published in the Official Gazette dated August 11th 2022 and entered into force the same day.

Yönetmelik değişikliği ile beraber yayımlanan 04.04.2022 tarihli 11098 sayılı EPDK Genel Kurul Kararı ile de odak noktası lisanssız üretim modelinde öz tüketim olan sanraller için birtakım yenilikler getirildi.

On the same day, they published the 04.04.2022 dated and 11098 numbered EMRA General Assembly Resolution focusing on self-consumption in the unlicensed generation model.

Söz konusu düzenlemelerin başında, 12 Mayıs 2019 tarihinden sonra devreye giren tesislerin sisteme satışa konu edebilecekleri elektrik üretimlerine getirilen sınırlama gelmektedir. İlgili tesisin cari yıl içinde yapabileceği ihtiyaç fazlası elektrik üretim satış miktarı bir önceki yılda gerçekleştirdiği toplam tüketim ile sınırlandırılmıştır. Sınırın üstünde kalan elektrik üretimleri ise Yenilenebilir Enerji Kaynaklarını Destekleme Mekanizması’na (YEKDEM) bedelsiz katkı olarak kabul edilecektir.  Lisansız üretim yapan ve öz tüketim kapasitesinin üzerinde üretimi bulunan santraller için bu durum çok ciddi bir gelir kayı anlamına gelmektedir.

One of the main regulations set out is the limitation regarding the maximum amount of surplus electricity that can be sold to the system for the facilities that started to operate after May 12th, 2019. The amount of surplus electricity generation sales that the relevant facility can make in the current year is limited to the total consumption realized in the previous year. Electricity generation above the limit will be assessed as a free contribution to the Renewable Energy Resources Support Mechanism (YEKDEM). The change brought significant disadvantages and potentially great losses for the unlicensed facilities.

Mesken abone grubuna bağlı 50 kW altındaki kurulumlar bu düzenlemelerin kapsamında değildir.

Organizations under 50 kW that are related to the residential subscriber group are not within the scope of these regulations.

Ek olarak, yapılan düzenlemeye göre, organize sanayi bölgelerinde yer alan işletmeler farklı dağıtım bölgelerinde lisanssız yatırım yapabilecektir.

Additionally, according to the regulation, businesses located in organized industrial zones will now be able to make unlicensed investments in different distribution zones.
