Yenilenebilir enerji sektörü, Covid-19 Pandemisi nedeniyle tedarik zincirinde meydana gelen gecikmelerin projelere olumsuz etkilerini nedeniyle durumun mücbir sebep sayılmasını ve mekanizmanın uzatılmasını talep etmekteydi.

5346 sayılı Yenilenebilir Enerji Kaynaklarının Elektrik Enerjisi Üretimi Amaçlı Kullanımına İlişkin Kanun’a göre; “rüzgâr, güneş, jeotermal, biyokütle, biyokütleden elde edilen gaz (çöp gazı dahil), dalga, akıntı enerjisi ve gel-git ile kanal veya nehir tipi veya rezervuar alanı on beş kilometrekarenin altında olan hidroelektrik üretim tesisi kurulmasına uygun elektrik enerjisi üretim kaynakları” Yenilenebilir Enerji Kaynakları Destekleme Mekanizması’ndan (“YEKDEM”) faydalanabilmektedir. YEKDEM’den yararlanmak isteyen üretim tesislerinin ise 31 Aralık 2020’ye kadar devreye girmesi gerekmekteydi.

• Yeni Kararname Süre Uzatımı Getirdi

18 Eylül 2020 tarihli Resmî Gazete’de yayımlanan Cumhurbaşkanı Kararı ile YEKDEM’den yararlanmak isteyen üretim tesislerinin 31 Aralık 2020’ye kadar devreye girmesi şartına ilişkin süre 30 Haziran 2021’e uzatıldı. Buna göre, 1 Ocak 2021’den 30 Haziran 2021 tarihine kadar işletmeye girecek YEKDEM’e tabi Yenilenebilir Enerji Kaynakları (“YEK”) belgeli üretim tesisleri için belirlenen fiyat desteği 31 Aralık 2030’a kadar uygulanacak.

• Yerli İmalata Fiyat Desteğinin Yanı Sıra 5 Yıl Süre ile İlave Destek Verilecek

Belirlenen dönemde işletmeye girecek YEK belgeli üretim tesislerinde kullanılan mekanik ve elektro-mekanik aksamın yerli imalat olması halinde, bu tesislerde üretilen elektrik enerjisi için belirlenen fiyat desteğinin yanı sıra, üretim tesisinin işletmeye giriş tarihinden itibaren 5 yıl süreyle ilave destek verilecek.

Renewable energy sector was demanding the extension of the support mechanism and consideration of the negative effects of delays that occurred in the supply-chain as force majeure due to the Covid-19 Pandemic.

As per the Law on the Utilization of Renewable Energy Sources for the Purpose of Generating Electrical Enegry No:5346, “wind, solar, geothermal, biomass, biomass gas (including landfill gas), wave, current energy and tides, and electrical energy generation resources suitable for the establishment of a canal or river type or hydroelectric generation facility with a reservoir area of ​​less than fifteen square kilometers.” may benefit from the Renewable Energy Support Scheme (“YEKDEM”). Production facilities that would like to benefit from YEKDEM had to become commissioning until December 31, 2020.

• The New Decree Has Brought Time Extension

According to the Presidential Decree published in the Official Gazette on September 18, 2020, the commissioning deadline to benefit from YEKDEM until December 31, 2020 has been extended until June 31, 2021. Accordingly, the price support determined for the production facilities with YEKDEM certificate for Renewable Energy Resources (“YEK“), which will be operationalized from January 1, 2021 to June 30, 2021, will be applied until December 31, 2030.

• Additional Support Will Be Given  for 5 Years In Addition to Price Support for Domestic Manufacturing 

In the event of mechanical and electro-mechanical parts used in the production facilities with YEK certificate to be commissioned in the specified period are manufactured domestically, additional support will be given to the price support determined for the electrical energy produced in these facilities for 5 years from the date of the production facility’s commissioning date.
