| Yenilenebilir Enerji Kaynaklarından Elektrik Enerjisi Üreten Tesislerde Kullanılan Yerli Aksamın Desteklenmesi Hakkında Yönetmelik (“Yönetmelik”) hükümlerinde 28 Mayıs 2020 tarih ve 31138 sayılı Resmî Gazete ile birtakım değişiklikler yapılmıştır.
Düzenleme ile yerli katkı ilave fiyatından bir önceki dönem faydalanmış elektrik üretim tesisinde kapasite artışı, modernizasyon, yenileme veya kısmi kabuller ile işletmeye giren ünitelerin olması durumunda başvuru sahipleri tarafından yeni ünitelere ilişkin belgelerin 1 Ağustos’a kadar Enerji ve Tabii Kaynaklar Bakanlığı (“Bakanlık”) veya Bakanlığın görevlendirdiği kuruluşa sunulacağı öngörülmüştür. Aksi takdirde, başvuru değerlendirmeye alınmayacaktır. Yerli katkı ilave fiyatından yararlanmak isteyen üretim tesislerinde inşaat veya montaj yapılması sırasında toprak veya su altında kalacak olan ya da dışarıdan tespit yapılamayacak şekilde kapalı hale getirilmesi gereken aksam ve bütünleştirici parçalar, inşa edilmeden veya montajı bitmeden Bakanlık veya Bakanlığın görevlendirdiği kuruluşa lisans sahibi tüzel kişi tarafından bildirilecektir. Ayrıca yapılan değişiklikle eklenen Geçici 3. Madde kapsamında, 2021 yılında yerli aksam teşvikinden yararlanmak için yapılacak başvurunun son tarihi 1 Ağustos 2020 iken yapılan değişiklikle bu tarih 16 Ekim 2020 olarak değiştirilmiştir. Bununla beraber, 01.11.2020 ile 31.12.2020 tarihleri arasında ilk defa işletmeye girecek üretim tesisleri için yapılacak başvurular için son tarih 31.12.2020 olarak belirlenmiştir. Some amendments were introduced in the provisions of the Regulation on Promotion of the Domestic Components Used in Plants Producing Electric Energy from Renewable Energy Resources (“Regulation”) in the Official Gazette dated 28 May 2020 and numbered 31138.
According to the amendment, in the event that new units included in the plant due to capacity increase, modernization, renewal or partial acceptance of the electricity production plant, which has benefited from the additional domestic contribution price, the documents related to the new units will be submitted to the Ministry of Energy and Natural Resources (“Ministry”) or the institution appointed by the Ministry until 1 August. Otherwise, the application will not be evaluated. The components and integrative parts, which will be buried underground or submerge during construction or installation or that must be closed in such a way that they cannot be detectable from the outside, of the production plants that want to benefit from the additional domestic contribution price, will be notified to the Ministry or the institution appointed by the Ministry by the licensee legal entity before their construction or installation is completed. Furthermore, within the scope of the provisional Article 3 introduced by the amendment, the deadline for the application to be made in 2021 to benefit from the domestic component incentive was changed from 1 August 2020 to 16 October 2020. In addition, the deadline for applications for the production plants that will become operational for the first time between the dates 01.11.2020 and 31.12.2020 has been set as 31.12.2020.
