A new era in sharing financial data! Financial data on those living or working abroad could be shared with the country where they work.

TÜRMOB | Finansal Hesap Bilgilerinin Otomatik Değişimine İlişkin Çok Taraflı  Yetkili Makam Anlaşması Onaylandı

International cooperation in the field of taxation and prevention of tax losses is being carried out with the participation of many countries and it is also pursued by European Union (“EU”) and Economic Cooperation and Development Organization (“OECD”) that Turkey is a part of and international organizations and formations such as G20. As a result of the efforts of OECD, G20 and EU to combat tax loss and evasion on an international scale, the “Mutual Administrative Assistance Agreement on Tax Issues” was prepared and the said agreement was signed by 136 countries including our country as of today. The Agreement that was accepted by the Turkish Grand National Assembly and entered into force in in 2017 stipulates mutual cooperation and assistance in the fields of exchange of information, simultaneous tax inspections, foreign tax inspections, collection and notification between the parties.


Regarding the automatic information exchange part of the said agreement, “the Multilateral Competent Authority Agreement on Automatic Change of Financial Account Information” that 107 countries are party to as of today, was signed on 21.04.2017 and entered into force on 31.12.2019 in Turkey. According to this agreement, the signatory countries will collect the financial account information of the residents of the respective countries from the financial institutions on the basis of reciprocity and (automatically) share it with the relevant country every year without a separate request. The competent authority in Turkey to collect and share information for automatic information exchange is the Revenue Administration under the Ministry of Treasury and Finance.


In this context, financial information regarding deposit accounts, custody accounts, partnership and debt relationship interest, cash value insurance contracts and regular payment agreements at deposit, custody and investment institutions and certain insurance companies will be shared with the counterpart countries. The information to be changed will consist of information such as the person’s name and surname, address, country of residence and tax identification number, place and date of birth, account number, account balance or value, the total gross amount of income such as interest paid to the account during the year, dividends or income from assets held in the account. In all account types, the year-end balance of the account is subject to notification, while information about the source of the account balances (such as pension, rental income) is not within the scope of automatic information exchange. Real estate and vehicle information is also not within the scope of automatic information exchange. The fact that whether the information to be shared belongs to real persons (individual accounts) or institutions (corporate accounts) will not change the scope of sharing.

The above-mentioned information will be shared with the countries that have been reciprocated as of 2020, with the previous year’s information. First, it will start with the information of 2019. Signatory countries of Germany, the Netherlands, Belgium, Austria and France are not included in the 2020 information exchange schedule of Turkey. Information exchange with other countries on the list will be made on a reciprocity basis.

However, the European Union monitors countries that do not make automatic exchange of information with all member states through listing and discusses sanctions on these countries. Therefore, the number of countries that information is exchanged may increase in upcoming period.

Vergileme ve vergi kayıplarının önlenmesi alanında uluslararası anlamda iş birliği, pek çok ülkenin katılımıyla sürdürülmekte ve Avrupa Birliği (“AB”) ile Türkiye’nin de bir parçası olduğu Ekonomik İş birliği ve Kalkınma Örgütü (“OECD”) ve G20 gibi uluslararası kuruluş ve oluşumlarca da takip edilmektedir. OECD, G20 ve AB’nin uluslararası ölçekte vergi kayıp ve kaçağı ile mücadele çalışmaları sonucunda, “Vergi Konularında Karşılıklı İdari Yardımlaşma Sözleşmesi” hazırlanmış ve söz konusu sözleşme bugün itibarıyla ülkemiz dahil 136 ülke tarafından imzalanmıştır. 2017 yılında TBMM’de kabul edilerek yürürlüğe giren Sözleşme taraf ülkeler arasında bilgi değişimi, eşzamanlı vergi incelemeleri, yurt dışı vergi incelemeleri, tahsilat ve tebligat konularında karşılıklı iş birliği ve yardımlaşma yapılmasını öngörmektedir.



Söz konusu anlaşmanın otomatik bilgi değişimi bölümü ile ilgili olarak bugün itibarıyla 107 ülkenin taraf olduğu “Finansal Hesap Bilgilerinin Otomatik Değişimine İlişkin Çok Taraflı Yetkili Makam Anlaşması” ise Türkiye’de 21.04.2017 tarihinde imzalanmış ve 31.12.2019 tarihinde yürürlüğe girmiştir. Bu anlaşmaya göre, imzacı ülkeler, karşılıklılık temelinde, ilgili ülkelerin mukimlerine ait finansal hesap bilgilerini, finansal kuruluşlardan toplayıp ayrı bir talep gerekmeksizin (otomatik olarak) her yıl ilgili ülkeyle paylaşacaktır. Türkiye’de otomatik bilgi değişimi için bilgileri toplamaya ve paylaşmaya yetkili makam, Hazine ve Maliye Bakanlığına bağlı Gelir İdaresi Başkanlığıdır.

 

 

Bu kapsamda, mevduat, saklama ve yatırım kuruluşları ile belirli sigorta şirketleri nezdindeki, mevduat hesapları, saklama hesapları, ortaklık ve borç ilişkisi menfaati, nakdi değer sigorta sözleşmeleri ve düzenli ödeme sözleşmelerine ilişkin finansal bilgiler muhatap ülkelerle paylaşılacaktır. Değişime tabi tutulacak bilgiler ise; ilgilinin adı ve soyadı, adresi, yerleşik olduğu ülke ve vergi kimlik numarası, doğum yeri ve tarihi, hesap numarası, hesap bakiyesi ya da değeri, hesaba yıl içinde ödenen faiz, temettü gibi gelirlerin ya da hesapta tutulan varlıklardan elde edilen gelirlerin toplam brüt tutarı gibi bilgilerden oluşacaktır. Tüm hesap türlerinde hesabın yılsonu bakiyesi bildirime tabi olup, hesap bakiyelerinin kaynağına ilişkin (emekli aylığı, kira geliri gibi) bilgiler otomatik bilgi değişimi kapsamında değildir. Gayrimenkul ve taşıt bilgileri de otomatik bilgi değişimi kapsamında değildir. Paylaşılacak bilgilerin, gerçek kişi (bireysel hesaplar) veya kurumlara (kurum hesabı) ait olması paylaşım kapsamını değiştirmeyecektir.




Yukarıda belirtilen bilgiler 2020 yılından itibaren karşılıklılık sağlanan ülkelerle, bir önceki yıl bilgileri paylaşılacaktır. İlk olarak 2019 yılı bilgileri ile başlanacaktır. Anlaşmaya taraf ülkelerden Almanya, Hollanda, Belçika, Avusturya ve Fransa, Türkiye’nin 2020 yılı bilgi değişimi takvimine alınamamıştır. Listede yer alan diğer ülkelerle bilgi değişimi karşılıklılık esasına göre yapılacaktır. Bununla birlikte, Avrupa Birliği, tüm üye devletlerle otomatik bilgi değişimi yapmayan ülkeleri listeleme yoluyla izlemekte ve bu ülkelere yaptırım uygulamayı tartışmaktadır. Bu nedenle, önümüzdeki süreçte bilgi değişimi yapılan ülke sayısının artması söz konusu olabilecektir.
