5449 Sayılı Yurt Dışı Lojistik Dağıtım Ağlarının Desteklenmesi Hakkında Cumhurbaşkanı Kararı Yayımlandı

5449 SAYILI YURT DIŞI LOJİSTİK DAĞITIM AĞLARININ DESTEKLENMESİ HAKKINDA CUMHURBAŞKANI KARARI YAYIMLANDI	THE PRESIDENTIAL DEGREE NO. 5449 ON SUPPORTING INTERNATIONAL LOGISTICS DISTRIBUTION NETWORKS HAS BEEN PUBLISHED
20 Nisan 2022 Çarşamba günü Resmî Gazete’de yayımlanan 19 Nisan 2022 tarihli 5449 sayılı Cumhurbaşkanı Kararı ile 13.10.2020 tarihli ve 3080 sayılı Cumhurbaşkanı Kararı ile yürürlüğe konulan Yurtdışı Lojistik Merkezlerin Desteklenmesi Hakkında Karar yürürlükten kaldırılarak Yurtdışı Lojistik Dağıtım Ağlarının Desteklenmesi Hakkında Karar (“Karar”) yürürlüğe konulmuştur.	The Presidential Degree on Supporting International Logistics Distribution Networks, which was put into effect with the Presidential Degree dated 13.10.2020 and numbered 3080 was repealed by the Presidential Degree dated 19 April 2022 and numbered 5449 (“Decision”), published in the Official Gazette on Wednesday, 20 April 2022.
Karar’da ihracatın etkin ve kapsamlı akışını sağlamak, ihracatçıların uluslararası tedarik ve dağıtım zincirlerine daha hızlı ve rekabetçi fiyatlarla nüfuz etmelerini temin etmek ve en önemli pazarlardaki ihracat performansını istikrarlı kılacak altyapı olanaklarını oluşturmak olarak sayılan amaçları gerçekleştirmek adına Yurt Dışı Lojistik Dağıtım Ağlarının (“YLDA”) kurulması ve/veya işletilmesine ilişkin giderlerin Destekleme ve Fiyat İstikrar Fon (“Fon”)’undan karşılanmasına ilişkin usul ve esaslar düzenlenmiştir.	In order to achieve the objectives listed in the Decision such as ensuring the efficient and comprehensive flow of exports, enabling exporters to penetrate international supply and distribution chains more quickly and with competitive prices, and creating infrastructure opportunities that will stabilize export performance in the most important markets International Logistics Distribution Networks (“YLDA”) are formed and the procedures and principles of the Support and Price Stabilization Fund (“Fund”), have been regulated.
YLDA’lar, Bakanlık tarafından belirlenen YLDA’ların faaliyet gösterdiği veya göstereceği ülkede gümrükleme dahil çeşitli depoculuk hizmetlerini yerine getiren İşbirliği Kuruluşları tarafından sağlanan faaliyetlerin gerçekleştirilmesi için uluslararası taşımacılık ve lojistik amaçlı düzenlenmiş, en az iki veya daha fazla modlu farklı taşımacılık imkanlarına sahip tesisleri, bu tesisler ile entegre çalışacak dağıtım ağını ve bu ağın işletilmesine yönelik yük konsolidasyonunu sağlayarak uçtan uca tüm lojistik sürecini yönetecek bilişim ve sair sistemlerini ifade etmektedir.	YLDA’s are facilities with at least two or more modes of different transportation facilities, arranged for international transportation and logistics purposes, in order to carry out activities provided by Cooperation Organizations that perform various warehousing services, including customs clearance, in the country where YLDA’s operate or will operate, determined by the Ministry, It refers to the distribution network that will operate integrated with the facilities and the information and other systems that will manage the entire logistics process from end to end by providing load consolidation for the operation of this network.
Karara göre; · Yurt dışında ilk kez kurulan tesisler için belirli giderlerin (dağıtım ağı, cep depolar ve ağın işletilmesine yönelik kurulum, destek, bakım, bilişim sistemleri, teknik donanım, hukuki danışmanlık giderler vb.) %70’i oranında YLDA başına en fazla 60.000.000 TL, · Yurt dışında kiralanan veya üçüncü parti lojistik (3PL) hizmetlerinin satın alındığı Bakanlıkça uygun görülen cep depolar ve tesisler için giderleri (ruhsat ve izin, komisyon harcamaları, hukuki danışmanlık) ilk iki yıl %70 diğer yıllar %50 oranında ve YLDA başına yılda en fazla 24.000.000 TL, · YLDA için yurt dışında yapılan reklam, tanıtım, pazarlama faaliyetleri %50 oranında ve YLDA başına yıllık en fazla 1.200.000 TL, · YLDA’da yurt dışında istihdam edilen en fazla 10 kişinin brüt ücretleri ilk iki yıl %70, diğer yıllar %50 oranında (yıllık kişi başı 600.000 TL’yi geçmemek kaydıyla ve YLDA başına yıllık en fazla 4.800.000 TL Tutarında desteklenecektir.	According to the Decision the following expenditures will be supported as follows; • 70% of certain expenses (distribution network, mobile warehouses, and installation, support, maintenance, information systems, technical equipment, legal consultancy expenses for the operation of the network) for the facilities established abroad for the first time, maximum 60.000.000 TL per YLDA • Expenditures (license and permits, commission expenses, legal consultancy) for mobile warehouses and facilities, which are rented abroad or where third-party logistics (3PL) services are purchased, deemed appropriate by the Ministry, are 70% in the first two years, 50% in the other years, and maximum 24.000.000 TL per YLDA per year • Advertising, promotion, and marketing activities abroad for YLDA at a rate of 50% and a maximum of 1,200,000 TL per year per YLDA, • Gross wages of up to 10 people employed abroad at YLDA are 70% in the first two years and 50% in the other years (provided that it does not exceed 600,000 TL per person per year, and a maximum of 4,800,000 TL per year per YLDA).
Ayrıca Bakanlık tarafından uygun görülen navlun borsalarının kurulumu ve teknik altyapısının oluşturulmasına yönelik giderlerin %60 oranında ve en fazla 3.600.000 TL tutarında destekleneceği belirtilmiştir.	In addition, it has been stated that the expenses for the establishment of freight exchanges and the establishment of the technical infrastructure, which are approved by the Ministry, will be supported at the rate of 60% and a maximum of 3,600,000 TL.
YLDA’nın destek kapsamına alınması için İşbirliği Kuruluşları tarafından fizibilite raporunu da içeren bir proje ile Bakanlığa başvuru yapılması ve projenin Bakanlıkça uygun bulunması gerekecektir.	In order for YLDA to be included in the support, the Cooperation Organizations will need to apply to the Ministry with a project including a feasibility report, and the project will need to be approved by the Ministry.
YLDA’lar, Ticaret Müşavirliği, Ticaret Ataşeliği ve Bakanlık temsilcisi koordinasyonu ve denetimine tabi olacaktır. İş birliği kuruluşları destek unsurlarından en fazla 5 yıl süreyle yararlandırılacak olup, Bakanlığın Genelge ile belirlenen performans kriterleri kapsamında yapacağı değerlendirme neticesinde, performans kriterlerini son üç yıl boyunca karşılayan YLDA’lara 5 yılı aşmamak üzere ilave destek süresi verilebilecektir. Bununla birlikte performans kriterlerini birbirini izleyen 3 yıl boyunca karşılayamayan YLDA’lar destek kapsamı dışında bırakılacaktır. Destek süresi dolmadan destek kapsamından çıkarılan YLDA’lar yerine Bakanlık tarafından kapsamdan çıkartılan YLDA’nın yararlandığı süre mahsup edilerek yeni bir YLDA destek kapsamına alınabilecektir. Kararda desteklenecek YLDA sayısının toplam 8’i geçemeyeceği ve başvuru esaslarına ilişkin hususların Genelge ile belirleneceği düzenlenmiştir.	YLDA’s will be subject to the coordination and supervision of the Trade Counselor, Trade Attaché and Ministry representative. Cooperation Organizations will benefit from the support elements for a maximum of 5 years, and as a result of the evaluation made by the Ministry within the scope of the performance criteria determined by the Circular, an additional support period not exceeding 5 years may be granted to YLDA’s that have met the performance criteria for the last three years. However, YLDAs that do not meet the performance criteria for 3 consecutive years will be excluded from the support. The Ministry may appoint a new YLDA instead of YLDAs that were excluded from the scope of support by deducting the time benefited by the YLDA, which was excluded from the scope before the end of the support period. In the decision, it is regulated that the total number of YLDAs to be supported cannot exceed 8 and the issues regarding the application principles will be determined by the Circular.
