2021 Yılı Merkez Bankası Temerrüt Faizi Oranı

Central Bank Default Interest Rate for 2021

02.01.2021 tarihli Resmi Gazete’de yayımlanan Türkiye Cumhuriyet Merkez Bankası (“Merkez Bankası”) tarafından çıkarılan 31352 sayılı Tebliğ ile 2021 yılı için mal ve hizmet tedariklerinde temerrüt faizi oranı belirlenmiştir.

6102 sayılı Türk Ticaret Kanunu’nun 1530’uncu maddesinin yedinci fıkrası uyarınca mal ve hizmet tedarikinde alacaklıya yapılan geç ödemelere ilişkin temerrüt faiz oranının sözleşmede öngörülmediği veya ilgili hükümlerin geçersiz olduğu hallerde uygulanacak faiz oranı 1 Ocak 2021 tarihinden itibaren yüzde 18,25 ve alacağın tahsili masrafları için talep edilebilecek asgari giderim tutarı 385,00 TL olarak belirlenmiştir.

2020 yılı için temerrüt faiz oranı yüzde 15 ve asgari giderim tutarı 260,00 TL şeklinde uygulanmıştır.

Pursuant to the Communiqué No. 31352 issued by Central Bank of the Republic of Turkey (“Central Bank”) published on Official Gazette dated 02.01.2021, the default interest rate of 2021 for the procurement of goods and services has been determined.

According to the seventh paragraph of Article 1530 of the Turkish Commercial Code No. 6102, as of 1 January 2021, the default interest rate to be applied for the late payments to the creditor for procurement of goods and services in cases where the default interest rate has not been stipulated in the contract or where the relevant provisions are void, has been determined as 18,25 percent and the minimum costs that can be requested for the debt collection expenses has been determined as 385,00 TL.

For 2020 the default interest rate was determined as 15 percent and the minimum cost as 260,00 TL.
